Terms and Conditions
Zameen Mitra
Last updated and effective: 19 September 2026
1. WHO WE ARE
Zameen Mitra is operated by Midpath Software Private Limited ("Midpath", "we", "us"), 95-B, Vidhyut Nagar, Jaipur – 302019. We are a private company. We are not a government department, authority, registry, court, or agent of any government body.
By creating an account, requesting a service, recharging a wallet, or using the platform, you agree to these Terms and our Privacy Policy. You must be at least 18 years old and legally capable of entering into a contract.
2. OUR SERVICES
We provide service outputs including Zameen Reports, ownership chains, mediation, consultation, khata/khasra discovery, self-service GPS surveys, copies of documents available through government systems as part of reports, and processed information based on such documents and reports.
Government documents and records remain the records of the relevant authority. Midpath does not own, alter, or control government source records. Our processing may be automated and may be validated by employees or independent contractors. We use statistical quality controls, but do not guarantee that every output is complete, current, error-free, or suitable for a particular transaction.
Our outputs are informational services. They are not legal advice, a government certificate, a conclusive title opinion, or a substitute for checking original records with the competent authority and obtaining appropriate professional advice. If our output differs from an official government record, the official record prevails.
3. SERVICE COMPLETION AND AVAILABILITY
Availability depends on government portals, source records, user-supplied details, networks, and third-party systems outside our control. Delivery times are estimates.
If a required government portal remains unavailable, we may keep trying for up to two days. We may then close the request and return that service charge only to the user's Zameen Mitra wallet. It will not be refunded to a bank account, card, UPI account, or other original payment method. The returned amount retains the original recharge's expiry date.
A completed search in which no requested document or record is found on the relevant portal is a completed service, not failed delivery, and is not refundable. Midpath is not responsible for omissions, indexing errors, delays, or inaccuracies in government systems.
Users must provide accurate property and request details. Charges arising from incorrect or incomplete details supplied by a user are not refundable.
We are not responsible for delay or failure caused by events beyond our reasonable control, including natural disasters, government action, changes in law, strikes, civil disruption, or failures of government, telecommunications, hosting, payment, or other third-party systems. Where such an event prevents completion, the portal-unavailability wallet-credit process above applies.
A user may cancel a request before Midpath or an assigned contractor starts work. The service charge will be returned only to the user's Zameen Mitra wallet and retains the original recharge's expiry date. Once work starts, the request cannot be cancelled or refunded except where required by law.
4. PAYMENTS, WALLET AND REFUNDS
Payments and wallet recharges are final and non-refundable except for the wallet credit expressly described in Section 3.
Each recharge expires three months after its recharge date. Expired amounts are forfeited and cannot be used or restored. Amounts returned after portal unavailability retain the corresponding recharge's original expiry date. Any unused wallet balance is forfeited when the account is closed, whether closure is requested by the user or results from a breach of these Terms.
The wallet is a limited facility for purchasing Midpath services. Its balance is not a bank deposit, cannot be transferred between users, earns no interest, and cannot be redeemed for cash.
Payments are processed by third-party payment providers, including Razorpay, under their applicable terms and privacy practices. Applicable prices and taxes are displayed at purchase and may change prospectively.
5. ACCOUNTS AND COMMUNICATIONS
You are responsible for your phone number, login credentials, devices, account activity, and promptly reporting unauthorised use. We may rely on instructions received through an authenticated account.
Where you consent, we may send OTPs and service-related updates through WhatsApp. We may also send OTPs by SMS. You may withdraw optional channel consent, but we may still send communications necessary to fulfil requests, secure the account, or comply with law through an available lawful channel.
6. USER MATERIAL AND CONDUCT
For services such as GPS surveys, users may submit photographs, locations, measurements, and property details. You confirm that you may lawfully provide them, including personal data about other persons, and instruct us to process them. You retain ownership of user-submitted material and grant Midpath a limited licence to use it to provide, secure, improve, and document the requested service and comply with law.
GPS survey measurements and maps are approximate. They are not cadastral surveys, official demarcations, proof of boundaries or title, or a substitute for a survey or demarcation by the competent authority or an appropriately licensed professional.
You must not misuse the platform; impersonate another person; submit unlawful material; interfere with security; introduce malicious code; scrape, systematically extract, resell, or build a competing database from the platform; or infringe another person's rights.
7. INTELLECTUAL PROPERTY
Government source documents remain subject to the rights and rules applicable to those records. Midpath and its licensors retain rights in the platform, software, branding, report formats, selection, arrangement, annotations, processing, analysis, and other value added by Midpath. Purchasing a service gives you a personal right to use its output; it does not transfer Midpath's intellectual property or permit bulk extraction or resale.
8. CONTRACTORS AND THIRD-PARTY SERVICES
Services may be performed or validated by Midpath employees or independent contractors. Contractors receive only information reasonably necessary for their assigned work. Midpath may also use hosting, communications, analytics, advertising, payment, and other service providers as explained in the Privacy Policy.
Links or integrations belonging to third parties are provided for convenience. Midpath does not control their availability, records, content, or independent conduct.
9. SUSPENSION AND TERMINATION
We may reject, suspend, or terminate requests or accounts for unlawful use, fraud, security risk, non-payment, abusive conduct, breach of these Terms, or where providing the service is not reasonably possible. Where termination is due to breach, unused balance is forfeited. Account closure and personal-data requests are handled under our Privacy Policy, subject to records we must retain by law.
10. WARRANTIES AND LIABILITY
Services are provided on an "as available" basis to the extent permitted by law. Nothing in these Terms excludes rights or liabilities that cannot lawfully be excluded, including applicable consumer rights.
To the extent permitted by law, Midpath is not liable for indirect, incidental, special, punitive, or consequential loss; loss caused by government records or portals, user-supplied errors, or third-party systems; or decisions made without independent verification of our output.
To the extent permitted by law, Midpath's total liability arising from a particular service will not exceed the amount paid to Midpath for that service. This limitation does not apply where limitation is prohibited by law, including liability that cannot be limited for fraud, wilful misconduct, gross negligence, a personal-data breach, or deficient services under applicable consumer law.
You will indemnify Midpath against third-party claims and reasonable costs arising from your unlawful use, material you had no right to submit, or your material breach of these Terms, except to the extent caused by Midpath.
11. CHANGES
We may update these Terms prospectively. Material changes will be notified through the platform or another reasonable channel. Changes apply prospectively and do not alter the terms governing an already-paid request unless required by law or expressly accepted by you. Continued use after the effective date constitutes acceptance for later use; if you do not accept, you must stop using the platform and close your account.
12. GOVERNING LAW AND JURISDICTION
These Terms are governed by Indian law. Subject to any forum rights that cannot lawfully be excluded, courts in Jaipur, Rajasthan have exclusive jurisdiction over disputes relating to the platform or services.
13. GENERAL
If part of these Terms is unenforceable, the remainder continues in effect. Failure to enforce a provision is not a waiver. These Terms and incorporated policies form the agreement concerning use of the platform; specific written service terms prevail where they expressly conflict.
